Products European Commission locks horns with Germany over data retention law European Union regulators have warned Germany that it must implement the controversial Data Retention Directive within one month or face legal action and possible fines. The Data Retention Directive requires EU member states to store vast amounts of telecommunications information, including data about email, phone calls and text messages, for law enforcement purposes. Comment: Following the quite disturbing news about the EU Data Retention Directive (as reported in LASN last week) that requires member states to store vast amounts of telecommunications data, Locks and Security News in its attempt to find out whether the UK has already signed up to it, recently received the following quote from a UKIP member of the European Parliament: "I think the article tells you where it is at. Germany among others have ruled it unconstitutional. If they don’t obey it will end up in the European Court of Justice. I would put my money on them upholding EU law and forcing Germany and the others to comply. As we know EU law takes precedence over national law and the ECJ is an engine of political integration." For those overseas readers who don't know, UKIP is the political party committed to the UK withdrawing from the EU and freeing itself of the 5000 or more laws that come out every year from Brussels. We also heard direct from the Information Commissioners Office which has just published its recommendations, and their email to LASN is featured below. But the recommendations as far as we can see, are only about the mechanics of the Directive, not whether it is a good thing or a bad thing for the UK. Meanwhile, the Daily Mail has picked up on the government data snooping story, as also featured below. UPDATE: Just before this issue of Locks and Security News was broadcast, we heard from the Home Office that yes, as we feared, the EU Data Retention Directive already applies in the UK. So how come it was not debated in Parliament? Ah, it is a Directive, so the rules of democracy don't apply... The publication of these proposals is important to the UK as the UK Data Protection Act is drawn from the European Directive and therefore the EU's new proposals also have a direct impact on the future of the Data Protection Act in the UK. The ICO's initial response to the proposals was published on the ICO website the same day as they were announced.
